These Terms govern your access to and use of Kuestify. The version currently in force is identified by the version number above. Please read them carefully; by using the Service you agree to them.
1. Who we are
Kuestify (the "Service") is operated by xSolia LLC, a limited liability company organized under the laws of the State of Texas, United States ("xSolia", "we", "us", or "our"). The Service is available on the web at kuestify.com and through our mobile applications. These Terms of Service ("Terms") form a binding agreement between you and xSolia LLC.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By creating an account you confirm that the information you provide is accurate and that you will keep it up to date.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Each person may maintain a single account. Notify us at support@kuestify.com promptly if you suspect unauthorized use. We may suspend or terminate accounts that are inactive, duplicated, or used in violation of these Terms.
3. The Service
Kuestify is a platform for early-stage product validation and collaboration. Members can publish validation topics and projects, submit structured feedback, browse and vote on early ideas in the innovation pool, look for partners or co-founders, and offer or earn product-access rewards. You may also connect your own social accounts (such as X, LinkedIn, a Facebook Page, or Instagram) so that Kuestify can publish posts you create to those accounts on your behalf (see Section 10). Features, rewards, and access levels may depend on your subscription tier and on verification status. We may add, change, or remove features at any time.
4. Member conduct and content
You retain ownership of the content you submit (including projects, responses, ideas, profile information, and messages). You grant xSolia a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate, provide, and improve the Service. You represent that you have the rights to the content you submit and that it does not infringe the rights of others or violate any law.
You agree not to: post unlawful, infringing, deceptive, harassing, or harmful content; impersonate others or misrepresent your affiliation; spam, scrape, reverse-engineer, or place undue load on the Service; attempt to bypass security, rate limits, or anti-abuse measures; or use the Service to defraud other members. We may remove content and restrict accounts that violate these rules.
5. Creator verification and biometric consent
Certain features, payouts, or rewards may require identity verification. Where verification is required, it is performed by our verification provider, Stripe Identity, and may involve a government-issued ID and a biometric likeness check (for example, comparing a selfie to your ID).
By starting verification, you give your explicit consent to this processing, including the processing of biometric data for the sole and limited purpose of confirming your identity. The identity documents and biometric data are collected and processed by Stripe; xSolia does not receive or store the underlying identity documents or biometric identifiers — we receive only the verification result, status, and reference identifiers, which we retain as described in our Privacy Policy. You may decline verification, in which case some features may be unavailable. Verification does not guarantee eligibility for any specific feature.
6. Rewards and member-to-member dealings
Rewards such as early access, beta access, or other product benefits are offered by creators to contributors. xSolia is not a party to those arrangements and does not guarantee that any reward will be granted, honored, or have any particular value. Disputes between members regarding rewards or collaboration are between those members; we may, but are not obligated to, assist.
7. Subscriptions and billing
The Service offers a free tier and paid subscription tiers (currently the creator plans). Paid subscriptions are billed in advance on a recurring basis and renew automatically until cancelled. On the web, payments are processed by Stripe; on mobile, purchases are made through the Apple App Store or Google Play and managed via RevenueCat, subject to the applicable store's terms.
When you start a paid subscription, we present the price, billing frequency, and renewal terms beforehand, and you expressly authorize recurring charges until you cancel. You can cancel at any time from your billing settings (web) or through your app store (mobile); cancellation stops future renewals, and access continues until the end of the current paid period. Where required by applicable auto-renewal law, we will provide clear renewal disclosures, an easy online cancellation method, and renewal reminders. We may change prices or plan features with reasonable notice; changes take effect at your next renewal.
8. Refunds
Refunds are handled on a case-by-case basis — contact support@kuestify.com and we will review your situation. Nothing here limits any non-waivable refund or cancellation rights you may have under applicable law. For purchases made through a mobile app store, refunds are governed by that store's policies and must be requested through the store.
9. Copyright and DMCA notice-and-takedown
We respect intellectual property rights and respond to clear notices of alleged copyright infringement. If you believe content on the Service infringes your copyright, send a written notice to support@kuestify.com (attn: Copyright Agent) that includes: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your name, address, and contact details; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf; and (f) your physical or electronic signature.
We may remove or disable the material, notify the member who posted it, and accept counter-notices. We will terminate, in appropriate circumstances, the accounts of members who are repeat infringers.
10. Third-party services
The Service relies on third-party providers (including payment, identity verification, chat/messaging, error monitoring, and anti-abuse services). Your use of features powered by these providers may also be subject to their terms. We are not responsible for third-party services we do not control.
Connected social accounts and posting on your behalf. If you connect a social account (such as X, LinkedIn, a Facebook Page, or Instagram), you authorize xSolia to access that account and publish the content you submit, using the permissions you grant. You are responsible for the content you publish and for complying with each platform's terms and policies (for example, X's automation rules and Meta's platform policies), and you confirm you are authorized to post to the connected account or page. We publish only at your direction and on a best-effort basis: we do not guarantee that any post will be delivered, and a platform may rate-limit, reject, or remove content. You can disconnect an account at any time in your settings, which revokes our access going forward.
11. Intellectual property
The Service, including its software, design, trademarks, and content we provide, is owned by xSolia LLC or its licensors and is protected by law. Except for your own content, nothing in these Terms grants you any right to our intellectual property.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that feedback obtained through it will be accurate or lead to any particular outcome.
13. Limitation of liability
To the maximum extent permitted by law, xSolia LLC and its officers, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD 100.
14. Indemnification
You agree to indemnify and hold harmless xSolia LLC from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or of any law or third-party right.
15. Suspension and termination
You may stop using the Service at any time and may delete your account. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Sections that by their nature should survive termination (including content license for residual copies, IP, disclaimers, liability limits, and indemnification) will survive.
16. Changes to these Terms
We may update these Terms from time to time. The current version is identified by the version number shown above. For material changes we will provide notice through the Service or by email, and where required we will ask you to re-accept. Continued use after changes take effect constitutes acceptance.
17. Dispute resolution and governing law
Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@kuestify.com and to attempt in good faith to resolve the dispute informally for at least 30 days.
Governing law and venue. These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Subject to any non-waivable rights under your local law, you agree that the state and federal courts located in Texas will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
